Terms and Conditions
1. Introduction
Welcome to Luxelane Limousine Services. These Terms and Conditions ("Terms") govern your use of our limousine services. By booking and utilizing our services, you ("You" or "the Client") agree to be bound by these Terms. Please read them carefully.
2. Definitions
Company: refers to Luxelane Limousine Services, including its employees, drivers, and affiliates.
Client: refers to the person or entity booking and using the limousine services provided by the Company.
Service: refers to the transportation services offered by the Company.
3. Booking and Payment
Reservations: All reservations must be made in advance. Reservations can be made via phone, email, or through our online booking system. All vehicles are quoted subject to availability at the time of booking. The Company reserves the right to require a deposit or full payment at the time of booking. Customer who reserves the Service should be 18 years of age or older.
Deposit: For hourly services, a deposit is required at the time of booking. The deposit amount will be the minimum of 3- hours required for the Service. The balance is due before the scheduled service date. We recommend that you complete it as soon as possible to ensure availability.
Payment Methods: All payments are due at the time of Service unless otherwise agreed upon. We accept payment via PayPal, Venmo, all major credit cards, such as Visa, Master Card, Amex and others.
Invoices: For customers with established accounts, all invoices are due and payable within 30 days of the invoice date, unless otherwise specified in a written agreement. Payment must be made in full by the due date. Any invoice not paid within 30 days will incur a 10% late payment fee, which will be added to the outstanding balance. This fee will continue to accrue on a monthly basis until the balance is paid in full.
4. Cancellations and Refunds
Cancellation Policy: Cancellations made 24 hours before the Service date will receive a full refund. Cancellations made within 24 hours may incur a cancellation fee equivalent to 35% of the total booking cost.
No-Show Policy: In the event of a no-show by the Client, no refunds will be issued.
5. Service Inclusions and Exclusions
Inclusions: Our service includes tolls, parking fees, and airport fees.
Exclusions: The following are not included in the Service fee: gratuity, additional stops not included in the initial booking, cleaning fees for excessive dirt and damage to the vehicle and extra charges for waiting time beyond the complimentary period.
6. Client Responsibilities
The Client is responsible for providing accurate details for the booking, including pick-up and drop-off locations and times.
Conduct: Clients are expected to behave appropriately while using our service. The Company reserves the right to terminate the Service, without refund, if the driver deems the conduct of the passengers to be unsafe or inappropriate. Any damage to the vehicle caused by the Client or their guests will result in additional charges.
We are not responsible for any injuries incurred as a result of physical altercations between passengers. We are not responsible for any injuries due to intoxication.
Drugs: Consumption of drugs in the vehicle is not allowed. We reserve the right to terminate the Service, without a refund, if these rules are violated.
7. Vehicle Use
Capacity: Clients must adhere to the vehicle’s passenger capacity limits as stipulated at the time of booking.
Personal Property: We are not responsible for any loss or damage to personal belongings left in the vehicle.
Vehicle Breakdown: We ensure that all vehicles are regularly maintained and serviced to the highest standards. In the rare event of a vehicle breakdown, we will endeavor to provide a replacement vehicle as soon as possible. The company reserves the right to subcontract this limousine service to another supplier in the event of an emergency.
8. Delays and Force Majeure
Delays: While we strive to be punctual, we are not liable for delays caused by factors beyond our control, including traffic, weather conditions, or mechanical issues.
Force Majeure: We are not liable for failure to provide service due to circumstances beyond our control, such as natural disasters, strikes, or other unforeseen events.
9. Company Responsibilities
The Company will comply with local and federal transportation regulations. The Company will provide a licensed, insured, and professional drivers. We will ensure that the vehicle provided is clean, well-maintained, and in good working condition.
10. Liability
Limitation of Liability: Our liability is limited to the amount paid for the service. We are not liable for any incidental or consequential damages arising from the use of our service.
11. Privacy
The Company respects your privacy and is committed to protecting your personal information. Please refer to our Privacy Policy for more details.
12. Changes to the Agreement
We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective upon posting on our website or through direct notification.
13. Governing Law
This agreement shall be governed by and construed in accordance with the laws of Puerto Rico.
14. Additional Charges
Definition: Additional charges may include additional hours beyond the contracted time, extra stops not included in the initial booking, special requests or services not included in the original booking, cleaning fees for excessive soiling, damages, or any other incidental costs incurred during the service.
Notification: You will be informed of any potential additional charges at the time of booking, during the service, or immediately after the service concludes. We aim to ensure that all charges are communicated clearly and agreed upon.
Billing and Payment Terms: Additional charges will be detailed on the final invoice and are due upon completion of service. For customers with an established account, charges will be billed to your account and are due within 30 days of the invoice date.
Dispute Resolution: If you believe any charges are incorrect or have questions about your invoice, please contact us within three business days of receiving the invoice. We will work to resolve any disputes promptly.
Authorization for Charges: By accepting our services, you authorize Luxelane Limousine Services to charge the payment method on file for any additional charges incurred during your service.
The following terms describe the circumstances under which additional charges may apply to your service:
a) Extra Stops:
We offer one complimentary short stop for up to 15 minutes within a certain distance from the main route. Additional stops or longer stops will incur extra charges. Unscheduled stops or deviations from the original itinerary or route will incur a charge of $25.00 per stop.
b) Waiting Time:
Waiting time refers to the period during which the chauffeur is waiting for the passenger(s) beyond the scheduled pickup time.
(i) Airport Pick-ups: A complimentary wait time of 1 hour is provided for domestic flights and 1.5 hours for international flights. This includes time spent waiting for flights to land and passengers to clear customs. After this period, waiting time will be charged at 1 full hour of service.
(ii) Other location Pick-ups: The complimentary waiting time is 20 minutes. At the end of your grace period, you will be charged $1.40 per minute for the wait time.
The waiting time will begin after your scheduled pickup time and your flight's actual landing time for airport pickups. If we do not hear from you after your grace period has ended, your trip will be canceled without a refund.
c) Cleaning and Damage Fees:
An additional cleaning fee will be charged if the vehicle requires excessive cleaning due to spills, stains, or other damage caused by passengers.
Spillage of drinks: $150.00
Vomiting in the limousine: $150.00
Cleaning fee for any kind of smoking: $250.00
Cigarette burns: $250.00
Ripped or damaged upholstery: $250.00
d) Car Seats:
For the safety of all our passengers, we require that appropriate car seats be used for children during their ride with us. If you need us to provide a car seat or booster, there will be a $10.00 charge per seat, per ride. You are welcome to bring your own car seat or booster, and there will be no additional charge.
Car Seat Requirements:
Children under 2 years old must be secured in a rear-facing car seat;
Children aged 2-4 must be in a forward-facing seat;
Children aged 4-8 with a height less than four (4) feet nine (9) inches and a weight of up to sixty-five (65) pounds, must be transported in a booster seat, convertible seat or car seat.
e) Special Requests and Amenities:
Any special requests (e.g., specific drinks or decorations) not included in the standard service may be subject to additional charges. These charges will be confirmed with the client in advance.
f) Late Payment Charges:
Invoices are due upon receipt unless otherwise agreed. Payments not received within 30 days of the invoice will incur a 10% late payment charge. Please note that continued non-payment may result in service suspension or legal action.
